Terms of Service

Effective Date: 1 August 2025

These Terms of Service (“Terms”) form a legally binding agreement between you (“User,” “you”) and Launch Window Limited (“Company,” “we,” “us”), a company registered in New Zealand, governing your access to and use of the Launch Window platform (“Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not accept them, you must not use the Service.

1. Eligibility and Accounts

1.1 You must register for an account to access the Service.

1.2 Accounts are granted to individual Users only and may not be shared, transferred, or used by multiple people or groups.

1.3 You are responsible for maintaining the confidentiality of your login credentials.

1.4 We reserve the right to suspend or terminate accounts at our sole discretion, including if account sharing is detected.

1B. Use on Behalf of an Organisation

1B.1 If you use the Service on behalf of a company, agency, or other entity (“Organisation”):

  • “You” includes both you as an individual and that Organisation,
  • You represent and warrant that you are authorised to bind the Organisation to these Terms, and
  • The Organisation is responsible for your compliance with these Terms and for all activity under its accounts.

1B.2 Where there is a conflict between these Terms and a separate written agreement between Launch Window Limited and the Organisation, the written agreement will prevail.

2. Fair Use

2.1 Use of the Service is subject to reasonable and lawful use.

2.2 You may not use the Service in ways that:

  • Place excessive or abnormal demand on our systems (for example, scraping, bulk downloading, or automated querying),
  • Circumvent technical limits or account restrictions, or
  • Otherwise disrupt or degrade performance for other Users.

2.3 We may monitor usage and take action, including suspension or termination, where we believe Fair Use has been exceeded.

3. User Content

3.1 Users may submit data, information, or other materials to the Service (“User Content”).

3.2 You retain ownership of your User Content.

3.3 By submitting User Content, you grant Launch Window Limited a worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and share such content with authorised Users of the Service.

3.4 You are solely responsible for the accuracy, legality, and completeness of your User Content.

3.5 We may remove or restrict User Content at our discretion.

4. Payments

4.1 Access to certain features requires payment. Pricing and payment terms are disclosed at the time of subscription or purchase.

4.2 Refunds are not provided except as required by law.

4.3 We may grant free access at our discretion.

5. Prohibited Uses

You agree not to:

  • Interfere with or disrupt the Service,
  • Submit false, misleading, or fraudulent information, or
  • Use the Service for unlawful or unauthorised purposes.

6. Intellectual Property

6.1 The Service, including its software, design, and trademarks, is the property of Launch Window Limited.

6.2 Nothing in these Terms transfers ownership of intellectual property rights in the Service.

6.3 User Content remains the property of the User, subject to the license granted under Section 3.

7. Third-Party Data

7.1 The Service may incorporate data from third-party sources.

7.2 Such data is provided “as is” without warranties. We disclaim responsibility for its accuracy, completeness, or availability.

8. Disclaimers and Limitation of Liability

8.1 The Service is provided “as is” without warranties of any kind.

8.2 Launch Window Limited disclaims liability for any damages arising from reliance on the Service or User Content, including delays, lost profits, flight disruptions, or personal injury.

8.3 To the maximum extent permitted by law, our total liability shall not exceed the amount paid by you to use the Service in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account immediately, with or without notice, if you breach these Terms, exceed Fair Use, or if we otherwise deem it necessary.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of New Zealand. You submit to the exclusive jurisdiction of the courts of New Zealand.

11. Privacy

We collect and process personal information, including names, email addresses, organisation details, and payment information. Our use of personal data is described in our Privacy Policy.
